Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Profile Borders iOS application (the "App"), provided by Paddyview Foundry ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App. Your use of the App is also subject to Apple's Licensed Application End User License Agreement and the App Store terms. If these Terms conflict with Apple's terms, Apple's terms apply to the extent of the conflict.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, as permitted by the App Store terms.

3. Subscriptions and Free Trials

You can try every border on your own photo for free. Saving and sharing your bordered pictures requires a Profile Borders subscription, offered as an auto-renewing subscription. Prices and available plans are shown in the App before you buy.

• Payment is charged to your Apple Account when you confirm the purchase.
• Subscriptions renew automatically at the same price and for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• If a plan includes a free trial, you will not be charged during the trial. Unless you cancel at least 24 hours before the trial ends, the subscription starts and you are charged at the end of the trial. Each Apple Account can use a free trial only once.
• You can manage or cancel subscriptions at any time in the iOS Settings app under your Apple Account > Subscriptions. Cancelling stops future renewals; you keep access until the end of the period you have paid for.
• All payments are processed by Apple. Refunds are handled by Apple under its policies; we cannot issue refunds directly.

You can restore previous purchases on your devices using "Restore Purchases" in the App.

4. Paddyview Foundry Bundle

A Profile Borders subscription also unlocks the premium features of our other apps listed in the App as part of the Paddyview Foundry bundle, and a qualifying purchase in one of those apps unlocks Profile Borders. Bundle access follows the status of the purchase that granted it: if a subscription ends, access ends in every bundled app. We may add or remove apps from the bundle, and features of each app may change over time.

5. Your Content

You keep all rights to the photos you use with the App. The App edits your photos on your device, and we do not receive or claim any rights to them. You are responsible for your content and for making sure you have the rights and permissions needed to use and share it, including the permission of any people who appear in your photos.

6. Border Artwork

The border designs in the App are our artwork. You may use the pictures you create with the App, including the borders in them, as profile or contact pictures and share them on your own personal or business accounts. You may not extract, resell, redistribute, or claim ownership of the border artwork on its own, or use it to create a competing product.

7. Third-Party Platforms

The App helps you create pictures for social networks, messaging apps, and other services. Your use of those services is governed by their own terms. Profile Borders is not affiliated with, sponsored by, or endorsed by any of them, and we are not responsible for how any service displays, crops, compresses, or handles your pictures.

8. Acceptable Use

You agree not to:

• Use the App to create or share content that is unlawful, that impersonates someone else, or that infringes anyone else's rights
• Modify, reverse engineer, or attempt to extract the source code or artwork of the App, except where permitted by law
• Attempt to bypass purchase verification or access paid features without a valid purchase

9. Intellectual Property

The App's design, border artwork, text, and code, including the Profile Borders name and logo, are owned by Paddyview Foundry and protected by applicable intellectual property laws.

10. No Warranty

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose or non-infringement. We do not guarantee that the App will be uninterrupted or error-free, or that your pictures will display a particular way on any service. Please keep your own copies of important photos.

11. Limitation of Liability

To the fullest extent permitted by law, Paddyview Foundry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or content, arising from your use of, or inability to use, the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App in the twelve months before the claim.

12. Changes to the App and These Terms

We may change, suspend, or discontinue the App or any feature, including individual borders, at any time. We may also update these Terms from time to time. Changes will be posted on this page with an updated effective date, and continued use of the App after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the applicable laws of the United States and, where state law applies, the laws of the state in which you reside, without regard to conflict of law provisions. Nothing in these Terms limits any consumer protection rights you have under the laws of the place where you live.
